These Online Payment Terms (the “Terms”) constitute a contract between you and Tiny Spoon Chef, Inc. Please read them carefully. You may either accept or decline the Terms as indicated at the bottom of this page, but to make payment via a credit card you must accept the Terms. All payments made using any online credit card processing facilities offered through Tiny Spoon Chef are subject to the following conditions.

You acknowledge, agree, and warrant that:

• You are 18 years of age or over; or, if using Tiny Spoon Chef’s services on behalf of a business, you are duly authorized to agree to the Terms on behalf of the business.
• You have the appropriate authority to validly accept the Terms and are able to and will meet your obligations in relation to these Terms.
• The credit card(s) used to make payment is issued in your name or you are authorized to use the credit card.
• Payments will be processed directly by the credit card processor.
• You accept and consent to your personal data being provided to the credit card processor for the sole purpose of offering and administering the online payment.
• The credit card processor is a third-party that is not affiliated with Tiny Spoon Chef. Tiny Spoon Chef shall have no liability whatsoever for any actions, conduct, or failure to act of the credit card processor with respect to payments or other transactions You choose to process through it, or any other use of its services.
• You may be required to agree to the credit card processor’s own terms and conditions in order to use its services.
• You will pay the credit card issuer all charges incurred in your use of Tiny Spoon Chef’s services
• You agree to pay any additional processing or convenience fee that may be assessed by and paid directly to the credit card processor for the use of its services.
• In the event any credit card payment fails or is rejected for any reason you will promptly make payment through an alternative payment method.
• The information supplied by you is true and correct.
• To the extent permissible by law, Tiny Spoon Chef may, at the inception of our services, and from time-to-time thereafter require you to provide information to verify your financial or personal information, such as credit card or banking information. We may make, directly or through third parties, inquiries to validate information that you provide to us. Tiny Spoon Chef may charge you a verification fee of up to $5.00 in each such instance.
• You will update all credit card or other payment account information promptly upon any change.

Credit card payment security:

• Tiny Spoon Chef maintains commercially reasonable administrative, technical and physical procedures to protect your personal and financial information from unauthorized access, accidental loss, or modification.
• Credit card numbers are protected with high level encryption when transmitted over the Internet. Tiny Spoon Chef cannot, however, guarantee that unauthorized third parties will never be able to defeat those measures or use such personal information for improper purposes.

Confirmation:

• When you complete the online payment form, funds will be deducted from your credit card in USD currency. All payments are debited to Tiny Spoon Chef, Inc.
• If successful, you will receive a confirmation notice of your completed payment once funds have been credited to Tiny Spoon Chef. Due to the way transactions are processed by the external banking sites, there may be delays of 1-3 days in updating your payment in our records.
• If unsuccessful, you will be advised that your payment has failed. Tiny Spoon Chef will not be advised why a payment has failed; therefore, you should contact your credit card provider for details.
• If your payment fails, please use one of the other payment methods described on your invoice to pay your invoice.

Your privacy and the protection of your data are important to us. You acknowledge that you have received, read in full, and agree with the terms of our Privacy Policy, and, as applicable, the card processor’s privacy policy. Our Privacy Policy is part of this Agreement.
